Twitter appeals ruling on protester tweets

Twitter is appealing a judge's ruling to hand over to prosecutors the tweets and account information of an?Occupy Wall Street protester.

The protester,?Malcolm Harris, is?being tried for disorderly conduct in connection with the?Occupy Wall Street march on the Brooklyn Bridge last fall. Authorities are trying?to use Twitter?posts made by Harris between September and December 2011?to prosecute him.

Harris has also filed a civil proceeding to block Criminal Court Judge Matthew Sciarrino's ruling that the information be turned over to the Manhattan district attorney's office.

In its?filing?Monday, Twitter asks the court to reverse the judge's order that it turn over the information. In part, Twitter said:

Did the trial court err in ruling that over 3 months of Defendant?s Tweets are unprotected by either the Fourth Amendment to the U.S. Constitution or art. I, ? 12of the New York Constitution when the U.S. Supreme Court and New York Court of Appeals have respectively held that the government must obtain a search warrant in order to gather data about a suspect?s public movements for periods of 28 and 65 days? Yes.

The American Civil Liberties Union plans to file a brief in support of Twitter.

In a blog posting ACLU attorney Aden Fine wrote that "the information demanded by the DA includes not only the contents of Harris?s tweets, but his private subscriber information ? including the IP addresses he used to access Twitter over three-plus months, which can reveal his physical location throughout that entire period."?

The D.A.'s office "also asked for the date, time, and duration of each of his Twitter sessions. By denying Twitter?s and Harris?s challenge, the court held that the government can access this wealth of sensitive personal information without satisfying basic constitutional protections. That isn't right."

So far, the?Manhattan D.A.'s?Office has declined to comment on the appeal.

How to send a video with iMessage from your iPhone or iPad

How to send a video message with iMessage from your iPhone or iPad

If you've got an iPhone, iPod touch, or iPad running iOS 5 or higher you've got iMessage, Apple's free MMS-like service that works with any other iOS device, and Mac running OS X Mountain Lion, to let you easily send videos without paying your carrier for a special messaging plan (data rates will still apply if you aren't on Wi-Fi). iMessage is built right into the same Messages app and Share Sheet that sends SMS and MMS to your non-iPhone using friends, so you don't have to do anything extra to use it. Just pick your video and send!

How to send an iMessage video using the Messages app

  1. Launch the Messages app from the Home screen.
  2. Tap the New Message button in the upper right hand corner
  3. iMessage and Messages main menu on iPhone
  4. Choose the contact you'd like to send a video to.
  5. Tap the Camera button next to the message entry area.
  6. Select whether you'd like to take a video now or choose an existing one.
  7. Choose existing or take video
  8. If you chose to send an existing video, you'll be shown all the pictures and videos in your Photos app. Scroll through and find the video you'd like to send. Tap on it to select it.
  9. Choose existing video for iMessage
  10. Review the video. If it's the one you want tap the blue Choose button in the lower right hand corner and it will be inserted into the message.
  11. Select iMessage video to send and confirm
  12. Tap the Send button and you're done!

If you're using an iPhone but the person you're sending to doesn't have an Apple device or isn't using iMessage, your video will be sent as a regular MMS message. If that happens, it will appear in a green bubble instead of a blue one. This also means you'll be charged any applicable text message or multimedia message fees.

If you're sending a video from your iPad or iPod touch, you won't be able to send an iMessage to anyone not using the service.

How to send an iMessage video from using the Photos app

  1. Launch the Photos app from your Home screen
  2. Choose existing video for iMessage
  3. Find the video you'd like to send and tap on it to select it.
  4. Tap on the Share button in the lower left hand corner.
  5. Select Message.
  6. choose video share button to send in message
  7. The video will be automatically inserted into a new message
  8. .Type the contact name or search for the contact you want to send to by tapping the blue + button.
  9. Tap the Send button and you're done!

Again, the person or people on the other end have to be using iMessage as well for the video to send. Otherwise they'll get an SMS if you're using an iPhone, or the iMessage will fail if you're using an iPod touch or iPad.

US home prices rose in all major US cities in June

(AP) ? U.S. home prices rose in June from May in every city tracked by a leading index, an encouraging sign that the housing market is improving.

The Standard & Poor's/Case-Shiller home price index showed increases in all of the 20 cities tracked for a second consecutive month. A measure of national prices rose 2.3 percent in June from May, the third straight increase. And home prices jumped nearly 7 percent in the April-June quarter from the previous quarter.

All but two cities in the national composite posted stronger gains in June than May. Detroit, Minneapolis, Chicago and Atlanta recorded the biggest one-month gains.

The increases partly reflect the impact of seasonal buying. The month-to-month prices aren't adjusted for seasonal factors.

As we all know, sprouts are packed with lots of nutrition. Sprouts have become an integral part in the daily diet for many people.

There has been a debate whether to eat sprouts raw or cooked.?


According to FDA, ?Rinsing sprouts first will not remove bacteria. Home-grown sprouts also present a health risk if they are eaten raw or lightly cooked. Cook sprouts thoroughly to reduce the risk of illness. Cooking kills the harmful bacteria.?

I recently bought a box of radish sprouts that looked so fresh and appetizing. After knowing that we should cook them thoroughly and avoid eating raw, I thought of making a curry with it for eating with chapathis. ?It came out so delicious. I didn?t use any oil for the curry and made it entirely in microwave.?

Ingredients: (Serves 1-2)

  • 1 cup Radish Sprouts
  • 1 Potato
  • 1 small Onion
  • 1 Tomato
  • ? tsp Cumin seeds
  • 2 or 3 Cloves
  • A pinch of Turmeric
  • Cilantro to garnish
  • Salt
  • ? tsp red Chili Powder
  • 2-3 Green Chilies


Method:

  1. Rinse radish sprouts well.
  2. Peel, wash and chop potato into cubes.
  3. Wash and chop onion + tomato + green chilies into small pieces.
  4. Add all these to a microwave safe bowl. Add cumin seeds + cloves + red chili powder + turmeric to the bowl and mix well.
  5. Add salt as needed and mix well. Pour a little amount of water to soak the contents.
  6. Microwave it for 10 min, mix and mw again for 5 more minutes or until the vegetables are cooked well.
  7. Leave it in the microwave for a minute, stir well and enjoy with chapathis.
  8. Yummy!!

Sony Launches Cyber-Shot DSC-RX100 in India

Isaac hugs Cuba coast; Cat 2 hurricane likely in Gulf

Haitians this morning are assessing the damage from Tropical Storm Isaac's landfall on a vulnerable country still recovering from the earthquake of 2010.

Updated at 3 p.m. ET:?Tropical Storm Isaac was hugging the northern coastline of eastern Cuba on Saturday after claiming at least three lives in Haiti. Isaac should become a Category 1 hurricane on Sunday just as it nears the Florida Keys, the U.S. National Hurricane Center said, and then grow into an even stronger Category 2 storm.

"Hurricane conditions are expected in the hurricane warning area in southwest Florida and the Florida Keys on Sunday," the center said in an advisory.

Florida Gov. Rick Scott on Saturday declared a state of emergency to make sure local and state agencies would be ready.

The center now expects Isaac to build to a Category 2 hurricane, with winds around 100 mph, after it enters the warmer waters of the Gulf of Mexico.

Isaac is a massive storm, with tropical storm-force winds extending 230 miles from the center. Key West International Airport was halting all flights at 7 p.m. Saturday until the storm had passed.


In Haiti, a woman and a child in the town of Souvenance were killed in the storm, a local official reported.

In the capital Port-au-Prince --?where some 350,000 people are still living in tents or shelters after the 2010 Haiti earthquake --?a girl, 10, was killed when a wall fell on her.

Power outages and flooding were reported as Isaac moved across the hilly and severely deforested Caribbean country.

"There's a lot of rain, a lot of wind," said Magdala Jean-Baptiste, who huddled with her frightened children in their home in the southern coastal city of Jacmel. "We haven't had any power since the storm started yesterday. We passed the night with no sleep."?

In neighboring Dominican Republic, Isaac felled power and phone lines and left at least a dozen towns cut off by flood waters. The most severe damage was reported along the south coast, including the capital Santo Domingo, where more than half the city was without power.

Cuba prepared by closing beaches and evacuating tourists in vulnerable areas, NBC's Mary Murray and The Weather Channel's Mike Seidel reported from Havana. Flights across Cuba were also suspended.?

In Baracoa, a city on Cuba's eastern side, high seas began topping the seawall Friday night, Radio Baracoa reported.?

Now with 60 mph winds, Isaac should exit Cuba on Sunday and then move south of the Florida Keys and into the Gulf.

Republicans are preparing to gather in Tampa, on Florida's central Gulf Coast, for Monday's start of their national convention ahead of the November presidential election.

The convention is expected to proceed as planned but Gulf of Mexico operators began shutting down offshore oil and gas rigs on Friday ahead of the storm.?

Tampa's weather forecast includes rain and high winds Sunday night and into Monday, The Weather Channel reported. The winds could gust up to 60 mph.

Monday and Tuesday include a risk of tornadoes across south Florida.?

Officials were handing out sandbags to residents in the Tampa area, which often floods when heavy rainstorms hit. Sandbags also were being handed out in Homestead, 20 years after Hurricane Andrew devastated the community there. Otherwise, however, convention preparations were moving ahead as usual.

Isaac's exact path is still unclear, but the hurricane center said models suggest it will make landfall somewhere?between the Florida Panhandle and New Orleans on Tuesday night.

The storm's anticipated path did shift closer to the Keys than previously forecast and emergency managers urged tourists to leave the islands if they could do so safely. A single road links the chain of islands to the Florida Peninsula.?

The fallout has begun just one day after a federal appeals court scrapped a major EPA rule designed to curb long-distance drifting power plant pollution ? and Louisville?s air quality may pay the price.
A Western Kentucky utility told the Kentucky Public Service Commission Wednesday that it intends to abandon pollution controls that would have allowed it comply with the U.S. Environmental Protection Agency?s Cross-State Air Pollution Rule, also known as the transport rule.?
Henderson-based Big Rivers Electric Cooperative, which owns and operates four generating stations and a 1,266-mile transmission system, could save its customers about $225 million by dropping pollution controls required for the transport rule, said Marty Littrel, cooperative spokesman.

Finally, set a budget and resolve to stick to it.

Keep in mind that this approach does not mean you can skip the planning stage. Poor planning is even more dangerous when you tackle the project in stages. Even if you don?t buy the appliances right away, for example, pick the models you want and make sure they will fit in the space. Having to rip out cabinets to make enough room for appliances is a nightmare, to say the least.

3. Hire a Pro

Hiring a designer comes at a cost, but a pro will significantly reduce your hassle. A designer?s job goes far beyond helping you make style decisions like which countertops and cabinets to buy. He or she can hire and schedule contractors, foresee potential problems and keep the project within time and budget constraints.

4. Shop for Materials Online

Think you can?t buy flooring or countertops online? Think again. There are plenty of online suppliers that will send free product samples to your home. Typically, you can request up to five at a time with no commitment to buy and no credit card required. In many cases, you don?t even have to return the samples.

Product samples save you the time and hassle of driving all over the place to home improvement, kitchen or flooring stores. Plus, you get to see how the colors and materials will look in your home.

5. Check Contractor Credentials

There?s nothing worse than dealing with an unreliable contractor. You know, workers that show up only some of the time or, worse, don?t show up at all. Even if you fire the contractor, you?re out time and money.

Before you hire any contractor, ask for references ? and actually check them. Check the company?s record with consumer organizations like the Better Business Bureau. If you?re a member, check Angie?s List. And most importantly, go with your gut. If something feels wrong, it probably is.

It happens all the time: The hard-working crew at a small business loses customers thanks to the sour grapes of one person.

It could be a disgruntled employee, an angry customer or even a competitor, says V. Michael Santoro, coauthor with John S. Rizzo of Niche Dominance: Creating Order Out of Your Digital Marketing Chaos.

?Anyone can post a bad review online and hurt your business,? says Santoro, who is a managing partner with Rizzo of Globe On-Demand, an internet technology company. ?Unfortunately, most business owners are not even aware that these bad reviews are out there.?

Seventy-two percent of buyers trust reviews as much as personal recommendations, and 70 percent trust consumer opinions posted online, according to a recent Nielsen Global Trust in Advertising Survey.

?A bad review published in a newspaper, or broadcast on radio or TV, is short-lived, but a bad review posted online can live indefinitely,? says Rizzo. ?With consumers now researching an average of 10 reviews before making a buying decision, and 70 percent trusting a business that has a minimum of six reviews posted, business owners need to be proactive in developing their online reputation. You need several positive reviews.?

Online searches have been streamlined, combining reviews with maps, pay-per-click advertising, local business directories and Facebook Fan pages, Santoro says. As damaging as bad reviews can be, positive reviews can be equally constructive, he says.

Rizzo and Santoro offer an Internet marketing strategy called ?reputation marketing,? described in the following steps:

? Develop a 5-Star Reputation: Begin by having your happy customers post great reviews about your business. Strive to have at least 10. Have each post to one of the following: Google Plus Local, Yelp, CitySearch, SuperPages, YP.com, your Facebook Fan page, etc. This needs to be a continuous process. Proactively ask your customers to post reviews.

? Market Your Reputation: Once reviews are posted, use a well-designed online marketing strategy to drive targeted traffic to your website. Ensure that your website can convert this traffic into customers. Additionally, showcase these third-party reviews on your website.

? Manage Your Reputation: Regularly check that the reviews being posted are positive. You can use Google Alerts for your business name; however, you will need to check the local directories, too, since they?re not picked up by Google Alerts. By building up the positive reviews, you can counter a poor one by sheer volume. You should also quickly post a reply to a negative review if they occur. Always be professional and indicate what action you have taken to remedy the situation.

? Create a Reputation Marketing Culture: Train your staff to proactively ask customers for reviews and to deal immediately with any customer who appears unhappy. A positive culture will encourage customers to post positive reviews about your business.

Better monitoring of food quantity makes self-control easier

ScienceDaily (Aug. 22, 2012) ? New research from the University of Minnesota's Carlson School of Management suggests learning how to stop enjoying unhealthy food sooner may play a pivotal role in combating America's obesity problem. The research, published in the Journal of Consumer Research, explores how satiation, defined as the drop in liking during repeated consumption, can be a positive mechanism when it lowers the desire for unhealthy foods.

"When people talk about self-control, they really imply that self-control is willpower and that some people have it and others don't when facing a tempting treat," says Joseph Redden, an assistant professor of marketing at the Carlson School and lead author of the 'Healthy Satiation: The Role of Decreasing Desire in Effective Self-Control.' "In reality, nearly everyone likes these treats. Some people just stop enjoying them faster and for them it's easier to say no."

Through a series of experiments, Redden and Texas A&M University assistant professor of marketing Kelly Haws discovered that when people with high self-control eat unhealthy foods they become satisfied with the experience faster than when they are eating healthy foods and thus eat less. In one study, the researchers asked participants to monitor themselves as they ate by counting how many times they swallowed. With this subtle clue to the amount eaten, those with low self-control became satisfied at a faster rate. Redden said they were surprised at how easy it was to recreate self-control -- just using a baseball pitch counter made low self-control people act like they had high self-control.

"People can essentially use attention for how much they are consuming instead of relying on self-control," Redden says. "Really paying a lot more attention to the quantity will lead people to feel satiated faster and eat less."

(AP) ? When the "Big One" rocked the East Coast one year ago, the earthquake centered on this rural Virginia town cracked ceiling tiles and damaged two local school buildings so badly that they had to be shuttered for good. Now as the academic year gets under way, students are reciting a new safety mantra: Drop, cover, and hold on.

Earthquake drills are now as ubiquitous as fire drills at Louisa County schools in central Virginia, where 4,600 students were attending classes when the 5.8-magnitude quake struck nearby on Aug. 23, 2011. Miraculously, no one was seriously hurt.

"It's the new normal," Superintendent Deborah D. Pettit said of the earthquake drills. "It's become a normal part of the school routine and safety."

One such drill is planned for Thursday at 1:51 p.m. EDT ? the precise moment a year ago when the quake struck.

The unexpected jolt cracked the Washington Monument in spots and toppled delicate masonry high atop the National Cathedral. The shaking was felt far along the densely populated Eastern seaboard from Georgia to New England.

While West Coast earthquake veterans scoffed at what they viewed as only a moderate temblor, last year's quake has changed the way officials along the East Coast view emergency preparedness.

Emergency response plans that once focused on hurricanes, tornadoes, flooding and snow are being revised to include quakes. Some states have enacted laws specifically related to the quake, and there is anecdotal evidence of a spike in insurance coverage for earthquake damage.

The quake was centered 3 to 4 miles beneath Mineral, a town of fewer than 500 people about 50 miles northwest of Richmond. Yet it was believed to have been felt by more people than any other in U.S. history.

The damage, estimated at more than $200 million, extended far beyond rural Louisa County. In the nation's capital, the Washington Monument sustained several large cracks and remains closed indefinitely.

The National Park Service plans next month to finalize the contract to repair the Washington Monument. Repairs are expected to cost $15 million and require a massive scaffolding, and the landmark obelisk is likely to remain closed until 2014. The National Cathedral reopened last November, but repairs are expected to take years and cost $20 million.

In Virginia, the North Anna Power Station became the first operating U.S. nuclear power plant shut down because of an earthquake.

Was it a once-in-a-century anomaly, or are there more quakes to come?

Scientists are trying to answer that question as they pore over the data and survey the epicenter from the air.

According to the U.S. Geological Survey, much of central Virginia has been labeled for decades as an area of elevated seismic hazard. But last year's quake was the largest known to occur in that seismic zone.

"Scientists would like to know if this earthquake was Virginia's 'Big One,'" said J. Wright Horton of the USGS.

Meanwhile, the quake prompted several jurisdictions to revise their emergency response plans.

"We learned a lot, that's for sure," said Laura Southard, a spokeswoman for the Virginia Department of Emergency Management. One lesson, she said: the need to conduct post-quake assessments to size up damage.

Ultimately, 6,400 homeowners and renters in nine Virginia localities received $16.5 million from the Federal Emergency Management Agency.

Virginia, Maryland and the District of Columbia are revising their emergency planning documents to include earthquakes. The response of many East Coast residents ? many of whom fled high-rise buildings ? went counter to the behavior recommended by experts during a quake.

"It's fair to say that no one thought we'd have an earthquake," said Christopher Geldart, director of the D.C. Homeland Security and Emergency Management Agency. The agency is hoping to educate the public about what to do next time. It is even encouraging participation in a regional earthquake drill this fall.

The agency has made changes in how it alerts local government employees and residents about disasters. It didn't send out an alert about the earthquake until 30 minutes afterward ? at which point many people had already decided to leave the capital and ended up in traffic jams for hours. Now, the goal is to send out a communication within 5 minutes. Those whose buildings aren't compromised will also be advised to stay put.

In Maryland, the state's first emergency quake exercise was conducted in April. The state was spared major damage a year ago. But Edward McDonough, a spokesman for the Maryland Emergency Management Agency, said: "It definitely shook us up, pardon the pun."

Insurance industry associations and regulators could not provide statistics on whether the earthquake inspired homeowners to add coverage for such an event, but a small percentage of property owners have it. State Farm spokeswoman Amy Preddy said less than 2 percent of its policyholders in Virginia have what is called an earthquake "endorsement," though she said the company has seen a small increase in coverage requests in Louisa and Fluvanna counties.

The Virginia General Assembly has passed legislation since that requires insurers to inform new and renewing customers whether earthquake coverage is excluded in their policies and whether it is available.

Dominion Virginia Power spent about 110,000 hours and $21 million on inspections, testing and evaluation of the North Anna Power Station after the quake. The U.S. Nuclear Regulatory Commission gave Dominion permission to restart the twin 1,800-megawatt reactors on Nov. 11 after inspections showed they did not suffer any functional damage.

Since the quake, Dominion also has installed additional seismic monitoring equipment. Dan Stoddard, senior vice president of nuclear operations for Dominion, said the plant's reactors have experienced no earthquake-related issues following the restart.

In New York, where skyscrapers shook and some feared another act of terrorism had befallen the city, the quake appears to have changed little. Emergency management officials said they were making minor changes to their internal planning, and the Metropolitan Transportation Authority has made no major policy changes.

The Indian Point nuclear plant, located about 35 miles from the city in Buchanan, N.Y., had already added safeguards to its facility after the meltdown triggered by an earthquake and tsunami at the Fukushima nuclear power plant in Japan.

Sara Nichols, 45, said wobbly buildings and a few tremors weren't enough to shake her.

"Unless it splits a building in half, I think New Yorkers are too hardcore to worry about taking safety precautions after something like that," she said.

LG has announced that its newest flagship phone, the Optimus Vu (see our review), will be available globally in September. It has been available in only Japan and Korea thus far and will see a release next month in the Middle East, Africa, Europe, Asia, Latin America and then the U.S. sometime this quarter. This news comes on the heels of LG's announcement that they have sold more than 500,000 worldwide already, which is quite impressive. That number will likely see a big increase once it hits more markets this fall.

The Optimus Vu sports a beautiful 5-inch screen, Android 4.0 (Ice Cream Sandwich), 8MP rear-camera, a 1.3MP front-facing camera and 32GB of memory. Also notable is the fact that the international Optimus Vu will run a quad-core NVIDIA Tegra 3 CPU, rather than the dual-core Snapdragon S3 found in the Korean and Japanese variants. Swimmer chases Cuba-Florida dream

Diana Nyad is making good progress in her latest attempt to swim to Florida from Cuba, her crew said Sunday.

"There's no stopping her now," the crew said on her blog.

After jumping into the waters off Havana on Saturday afternoon -- a day earlier than originally planned -- Nyad made it 21.7 statute miles in 18 hours, putting in 50 strokes a minute, her blog reported.

The full distance to Key West, Florida, is 103 miles, a trip expected to take Nyad 60 hours if the 62-year-old is successful in her attempt -- her fourth.

"After a rough first night," Nyad "is comfortable, confident, and still consistently stroking," a message on her official Twitter feed said.

She was stung by jellyfish on her lips, forehead, hands, and neck. Some stings were from box jellyfish, her blog said.

"Cheered by her crew as she swam toward the side of her escort boat, Voyager, for a feed this morning, she gave the thumbs up" and asked how the crew was doing, according to her blog. "Today is more like swimiming," Nyad said in a quote on the blog. "I don't know what you would call last night -- probably surviving."

An "unfriendly" one-foot chop of waves made her swim tougher overnight, the blog said, but at "present the current is no longer against her."

She began the swim a day early because the water seemed to be "fantastic," Nyad said at a news conference before beginning the swim. Her Xtreme Dream team "Has been brainstorming and thinking, 'We've got to get out there,'" she said.

Nyad's first attempt to cross the Straits of Florida was in 1978, when rocky seas left her battered, delirious and less than halfway toward her goal.

She returned to the effort twice last year. She was done in once by an 11-hour asthma attack and was later thwarted by box jellyfish stings.

Nyad insisted she was ready to try it again now, and acknowledged Friday, "I'm feeling tremendous inner pressure that this has got to be it, this has got to be the last time."

She's in the water without a shark cage, relying on electronic shark repellent and a team of divers to keep them away.

In the 1970s, Nyad won multiple swimming marathons and was one of the first women to encircle the island of Manhattan. She holds the world's record for longest ocean swim -- 102.5 miles from the island of Bimini in the Bahamas to Jupiter, Florida.

Nyad says she was 8 years old when she first dreamed about the possibility of swimming across the Straits of Florida. At the time, she was in Cuba on a trip from her home in Florida in the 1950s, before Fidel Castro led a Communist takeover in Cuba and its relations with the United States soured.

"I used to stand on the beach and I said to my mother, 'I wonder if anybody could swim over there," Nyad recalled saying, while pointing to the Keys.

In her 60s, she says, she still feels "vital (and) powerful" -- and definitely "not old." A successful swim ideally will inspire people her age and older not to let their age hinder them, Nyad said.

"When I walk up on that shore in Florida, I want millions of those AARP sisters and brothers to look at me and say, 'I'm going to go write that novel I thought it was too late to do. I'm going to go work in Africa on that farm that those people need help at. I'm going to adopt a child. It's not too late, I can still live my dreams,'" she said.

Warrantless cellphone tracking is legal, federal court rules

An interstate drug trafficker hauling a motorhome filled with marijuana isn?t the most sympathetic defendant. ?But a federal court?s declaration that?Melvin Skinner pretty much?should?ve known his pre-paid cellphone could be tracked via GPS ? and therefore cops?didn?t require a warrant to track him?? has repercussions that privacy advocates say deserve your attention.?

Even if you don?t drive around in recreational vehicles loaded down more than a thousand?pounds of pot.

On Tuesday, the 6th U.S. Circuit Court of Appeals?ruled that law enforcement officials don?t need a warrant to track suspects via cellphones. Attorneys argued to overturn Skinner?s many convictions, citing that the GPS location information that led to the defendant?s arrest was obtained in violation of the Fourth Amendment, which guards against unreasonable searches and seizures. This didn?t wash with the majority of judges over the case, who voted in a 2-1 ruling.

?When criminals use modern technological devices to carry out criminal acts and to reduce the possibility of detection, they can hardly complain when the police take advantage of the inherent characteristics of those very devices to catch them,? wrote Judge John Rogers in the majority opinion that will affect future cases in a huge chunk of the country.

Skinner was arrested in 2006, with 1,100 pounds of marijuana in the motorhome he was driving, after law enforcement officials tracked him via one of the pre-paid phones the drug ring purchased using false identities. Such ?burner? phones are regularly discarded by criminals to avoid tracking. In this case however, officials obtained Skinner?s number from another member of the ring, and then a court order that required the cellphone company to disclose ?cell site information, GPS real-time location, and ?ping? data? for Skinner?s phone.

Accessing this information, law enforced trailed?Skinner to a?Texas rest area where a drug-sniffing dog turned up 1,100 pounds of pot in the motorhome he was driving. Skinner was arrested, of course, and was convicted of ?conspiracy to distribute and possession with intent to distribute over 1,000 kilograms of marijuana, conspiracy to commit money laundering, aiding and abetting the attempt to distribute in excess of 100 kilograms of marijuana ? charges his lawyers say were derived by a warrantless search in violation of the Fourth Amendment.

Here's the crux, as it may relate to everyone else:?"There is no Fourth Amendment violation because Skinner did not have a reasonable expectation of privacy in the data given off by his voluntarily procured pay-as-you-go cellphone." That's what Judge Rogers stated in the in the majority opinion, where he cited the Stored Communications Act.?The law hamstrings the Fourth Amendment in relation to?wire and electronic communications ? noting that the use of?third-party providers diminishes a person's expectation of privacy.?

Rogers maintains his statement?within the context of committing a crime.?As the judge writes, "If a tool used to transport contraband gives off a signal that can be tracked for location, certainly the police can track the signal." Failing that, "technology would?help criminals but not the police."

This ruling is creating?cognitive dissonance among privacy advocates who note that in January, all nine members of the Supreme Court held that warrantless GPS tracking is unconstitutional. In that case, police tracked suspected drug dealer Antoine Jones for 28 days ? without a warrant ? via a GPS device they?d attached to his car.

"That the officers were able to use less expensive and more efficient means to track the vehicles is only to their credit," he wrote.

Given the ubiquity of cellphones ? most of which come with some form of GPS automatically enabled?? this latest ruling rings a warning bell among privacy advocates.

"Location data is extraordinarily sensitive. It can reveal where you worship, where your family and friends live, what sort of doctors you visit, and what meetings and activities you attend,"?Electronic Frontier Foundation?senior staff attorney Marcia Hofmann wrote in a blog post prior to the court's decision.

"Whether this information is collected by a GPS device or a mobile phone company, the government should only be able to get it with a warrant based on probable cause that's approved by a judge."

"The 6th Circuit?s cell-tracking opinion is really disappointing. It?s the first appeals court decision about cell tracking after the Supreme Court?s decision in United States?v. Jones and I?d hoped for a better result," Catherine Crump, staff attorney for the ACLU Speech, Privacy and Technology Project, told NBC?News.

Crump led the ACLU?s blockbuster analysis of collection of cellphone location data by local police. The results, released earlier this year, revealed that many of the 200 law enforcement agencies that responded to the ACLU?s public records request, track cellphones without a warrant.

In this latest, ruling, Crump said, ?the court seems to think that if criminals use cellphones, they can hardly complain if they are tracked through these phones. But the court?s reasoning deprives all of us of constitutional protection against warrantless cellphone tracking. And besides, even suspected bad guys have constitutional rights.?
